This Cookie Policy explains how the MyPropFirm.pl website, operated by MYPROPFIRM SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (NIP: 7352939866, REGON: 544343026, KRS: 0001230981, Podhalańska 23, Kluszkowce 34-440), uses cookies and similar tracking technologies.
This Cookie Policy forms an integral part of the Website’s Privacy Policy.
Legal basis for the use of cookies:
Since 10 November 2024, matters related to cookies have been regulated primarily by the Act of 12 July 2024 – Electronic Communications Law (PKE, Journal of Laws 2024, item 1221), which replaced the previously applicable Act of 16 July 2004 – Telecommunications Law in the area of cookies and tracking technologies.
The use of cookies and similar technologies is subject to:
- Article 399 PKE – the requirement to obtain consent for access to terminal equipment, with exceptions for strictly necessary cookies (Article 399(3) PKE),
- Article 398 PKE – the prohibition of electronic marketing without prior, voluntary consent,
- Article 362 PKE – reference to personal data protection regulations (GDPR) regarding the conditions for valid consent,
- Article 6(1)(a) GDPR – consent as the legal basis for processing data through optional cookies,
- Article 6(1)(f) GDPR – legitimate interest as the legal basis for strictly necessary cookies,
- EDPB Guidelines 2/2023 on technical scope of Article 5(3) of the ePrivacy Directive.
The Telecommunications Law Act (Articles 173 and 174), referred to in older cookie policies, ceased to apply on 10 November 2024 and is no longer the current legal basis.
2. What are cookies?
Cookies are small text files stored on your device by a web browser when you visit a website.
Types by source:
- First-party cookies – set by the mypropfirm.pl website.
- Third-party cookies – set by external services operating within the Website (e.g. Google Analytics).
Types by lifespan:
- Session cookies – automatically deleted when the browser is closed.
- Persistent cookies – stored for a defined period or until manually deleted.

Consent for optional cookies must be: freely given, specific, informed and unambiguous (Article 4(11) GDPR in conjunction with Article 362 PKE). A cookie banner with pre-selected checkboxes for optional cookies or without the option to reject them constitutes a breach of the regulations.

4.1. Strictly necessary cookies
Strictly necessary cookies are required for the operation of the Website under Article 399(3) PKE (exemption from the consent requirement for cookies necessary to provide a service requested by the user). You cannot reject them through our cookie banner – you may disable them in your browser settings, but this may prevent the Website from functioning properly.

4.2. Analytical cookies
These require your consent under Article 399(1) PKE and Article 6(1)(a) GDPR.
Google Analytics 4 (GA4) with Consent Mode v2
The Website uses Google Analytics 4 with Consent Mode v2 implemented:
- If you do not give consent: GA4 sends only anonymised, cookieless signals that do not contain personal data.
- If you give consent: GA4 sets cookies to analyse your activity during sessions.

Google LLC processes the data as a processor under a Data Processing Agreement (DPA). Data transfers to the United States are safeguarded under the EU-U.S. Data Privacy Framework.

4.3. Marketing and advertising cookies
The Website does not currently use active marketing tools (advertising pixels or conversion cookies). If such tools are implemented in the future (e.g. Google Ads, TikTok Pixel or similar tools), this Cookie Policy will be updated before they are launched, and Users will be informed of the changes in accordance with section 8. Any marketing tools will be activated only after obtaining the User’s separate, voluntary consent through the cookie banner, in accordance with Articles 398 and 399(1) PKE.
4.4. Affiliate cookies
When you click an affiliate link to a prop firm, the affiliate network or prop firm may store a cookie identifying your click in order to calculate a commission. These cookies are managed by the prop firms or affiliate networks – not by the Website Operator. Their names and lifespans depend on the particular firm or network. We recommend that you read the cookie policies of those entities.
Legal basis (on the Operator’s side): Article 6(1)(a) GDPR in conjunction with Article 399(1) PKE – consent given by the User through the banner.
5. Other tracking technologies
Web beacons (tracking pixels)
The Website does not currently use web beacons. If they are implemented in the future, this Cookie Policy will be updated, and technologies requiring consent will be activated only after such consent has been obtained.
Local Storage
Some tracking tools may use browser Local Storage instead of or alongside cookies. You can clear it in your browser settings, usually in the “Clear browsing data” section.
6. How to manage cookies
6.1. Website cookie banner
During your first visit, we display a cookie banner that allows you to:
- Accept all categories,
- Reject optional cookies (analytical, marketing, affiliate),
- Manage preferences – choose individual categories.
You may change your preferences at any time by clicking the “Manage cookie preferences” link in the Website footer.
In accordance with Article 399 PKE and GDPR:
- the default state of the banner must assume no consent to optional cookies (no pre-selected checkboxes),
- continuing to browse the Website without clicking “Accept” cannot be interpreted as consent.

7. Targeted advertising
If the Website implements targeted advertising tools in the future, advertising partners may store cookies on the User’s device only after obtaining the User’s voluntary consent through the cookie banner, in accordance with Articles 398 and 399 PKE. Before such tools are implemented, this Cookie Policy will be updated. In accordance with the DSA, targeting advertisements based on sensitive data (Article 26 DSA) and profiling minors are prohibited.
8. Updates to this Cookie Policy
This Cookie Policy may be updated due to changes in technologies used, legal regulations or the Operator’s practices. The date of the last update is indicated at the beginning of this document. We will inform you of material changes by posting a notice on the Website.
