This document consolidates consumer-related matters specific to the Vault Program. Other consumer rights and out-of-court dispute resolution procedures (mediation by the Trade Inspection, the Consumer Ombudsman, the Office of Competition and Consumer Protection (UOKiK), and the ADR body designated by the President of the Office of Electronic Communications under the DSA) are governed by the Website Terms and Conditions; here we reference them to avoid duplication.
1.1. Complaints regarding the accrual of points, tiers, redemption of rewards, promotional campaigns, or other matters relating to the Vault Program may be submitted to kontakt@mypropfirm.pl.
1.2. A complaint should include information allowing identification of the Participant (e.g. the account's email address) and a description of the matter. The Operator handles complaints within 14 days of receipt and informs the Participant of the outcome electronically.
2.1. Participation in the Program is free of charge and may be cancelled at any time (section 7 of the Vault Program Terms and Conditions).
2.2. Redeeming points for a reward does not involve any monetary payment and constitutes an agreement for the supply of digital content or a digital service. If a Participant who is a consumer requests that the use of the reward begin before the withdrawal period expires and expressly consents to this, acknowledging the loss of the right of withdrawal, the right of withdrawal expires at the moment use begins (Article 38 of the Polish Act of 30 May 2014 on Consumer Rights).
3.1. Rewards are challenge-type accounts (evaluation accounts) and other items listed in the Catalogue. The Program does not guarantee that a Participant will obtain a funded account, a payout, or pass an evaluation. Participation in an evaluation at a Partner, and its terms, are governed by that Partner's own terms and conditions.
3.2. Rewards-back rates determine the rate at which points accrue, not a guaranteed monetary value. Points accrue at a rate of 1,000 points per 1 USD of the amount of a qualifying purchase, multiplied by the rate applicable to the Participant's tier. The value of points upon redemption depends on the point prices in effect in the Catalogue at the time of redemption.
3.3. The Operator issues rewards within 5 business days of redemption. If issuing a reward proves impossible, in particular because cooperation with a Partner has ended, the Operator returns the redeemed points to the Participant's balance, which exhausts the Participant's claims in that respect (section 6 of the Vault Program Terms and Conditions).
3.4. The availability of individual rewards may be limited by territory where a Partner does not provide services to persons from a given country or region. Such a limitation concerns only the ability to redeem points for that specific reward and does not restrict participation in the Program, the earning of points, or redemption for other available rewards.
3.5. Issuing a reward constitutes taxable income for the Participant (income from other sources, Article 20(1) of the Polish PIT Act). The Operator issues a PIT-11 information return in accordance with Article 42a of the PIT Act and does not withhold tax; the Participant is responsible for their own tax settlement. Receiving a reward is conditional on providing tax data, and — for a non-resident — also on making a declaration of non-Polish tax residency (section 11 of the Vault Program Terms and Conditions).
3.6. The value of a reward is determined according to market prices in accordance with Article 11(2a) of the PIT Act. Where it is expressed in a foreign currency, it is converted into Polish zloty at the average exchange rate of the National Bank of Poland from the last business day preceding the day the reward is issued.
4.1. Where points have been credited incorrectly, in particular as a result of a technical error, the Operator corrects the balance and lifetime points to the value resulting from the Vault Program Terms and Conditions and informs the Participant of the correction and its reason. Points credited in error, in an amount not resulting from those Terms, do not constitute an acquired right (section 13 of the Vault Program Terms and Conditions).
4.2. Where the panel is unavailable in a way that prevents a Participant from making a submission within the applicable deadline, the Operator extends that deadline accordingly at the Participant's request.
5.1. Promotional campaigns run within the Program are governed by their own separate terms, published on the Website. Complaints regarding a campaign are handled under section 1 of this document.
